1. Acceptance of Terms
By creating an account or using PerfectPalette ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notice.
2. Account Registration
You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
You must be at least 16 years old to create an account. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Permitted Use
The Service is provided for lawful color palette design, analysis, and export purposes. You may use palettes, exports, and analysis results in your own projects — personal or commercial — subject to your subscription plan's entitlements.
You may not reverse-engineer, scrape, or systematically extract data from the Service. You may not use automated tools to access the Service beyond the documented API and MCP interfaces.
4. Subscription Plans and Billing
PerfectPalette offers free and paid subscription plans. Paid plans are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to change pricing with 30 days' advance notice. Price changes do not affect the current billing period.
5. Intellectual Property
The PerfectPalette engine, Chromatic Lexicon color library, scoring algorithms, UI, and documentation are owned by PerfectPalette. Your use of the Service does not transfer any ownership rights.
Color palettes and design assets you create using the Service belong to you. We claim no ownership over your generated content.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described in that policy.
7. API and MCP Usage
Access to the PerfectPalette API and MCP tools is subject to rate limits and entitlements defined by your subscription plan. Abuse or excessive usage may result in throttling or suspension.
8. Availability and Warranties
The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability. We will make reasonable efforts to maintain uptime and notify users of planned maintenance.
9. Limitation of Liability
To the maximum extent permitted by law, PerfectPalette shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or business opportunities.
10. Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which PerfectPalette operates, without regard to conflict-of-law provisions.
